Kingscliff and the Tweed Coast, NSW
Excavation and earthmoving in Casuarina
Planned as a beachside estate, Casuarina had about 3,250 people at the 2021 Census, on the coastal strip south of Cudgen Creek with the relocated Tweed Coast Road on its western edge. Council still applies its Casuarina Beach planning code to the estate. Earthworks here mean small jobs in sandy house yards, which suit Luke's compact posi-track and 5.5 t class Kubota, with the Fuso tipper carting the sand away.

Jobs Luke takes on in Casuarina

Trenching and drainage
Sand digs easily but slumps, so a service trench across a Casuarina yard is opened only as deep as needed and fenced off while open. Fitting and connecting the line is for your licensed plumber or electrician, then Luke closes the trench.

Soil removal and tipper
Sand left over from a trench or a garden rebuild shouldn't end up on the foredune or a neighbour's block. It leaves on the Fuso instead, about 7.5 t at a time, for a lawful tip or approved site, and every load is docketed.

Land clearing
The estate's planning code targets bitou bush and sets a no-net-loss rule for coastal banksia habitat, so check what may come out before work near the dunes. At the owner's request, Luke then digs out stumps and weedy beds.

Excavator hire
Fence posts and screening plants in sand go in through auger holes drilled by the Kubota, with Luke operating, placed clear of the acoustic bund along the Tweed Coast Road.

Casuarina backs onto the foredunes of the beach south of Cudgen Creek, a stretch that a local history walk, published with the Tweed Heads Historical Society, says was dredged for mineral sands during a boom that ran from after 1939 into the 1970s. Council's flood plan groups Casuarina with the coastal villages, where land has flooded from river, lake and ocean storm surge, and asks that any permitted filling drain to the street. The Casuarina Beach code required a dune management plan for the foredunes, and acid sulfate soil management plans with development applications for the estate's original lots.
Machines reach a Casuarina lot from the estate streets, because the Casuarina Beach code allows no direct vehicle access off the relocated Tweed Coast Road except at approved intersections. Measure the side gate or path at its narrowest with a tape in the photo, and show fences, pits, meters and any landscaping in the way. Beachfront owners should also show where the yard meets the dune.
Before you dig in Casuarina
Casuarina is in the Tweed Shire Council area. These rules are worth checking before the machine is booked. Luke lodges his own Before You Dig enquiry for every job.
| Check | What it means |
|---|---|
| Acid sulfate soils on low ground | Tweed Shire Council says acid sulfate soils are common along the Tweed Coast. Written approval is needed in most cases before they're disturbed, and Council's management plan for minor works can't be used where groundwater is likely to be disturbed or dewatering is likely. Those jobs need a site-specific plan. |
| Bringing in fill | Council says filling land needs development consent in most cases. On flood-prone land, get a Section 10.7 certificate and a Property Flood Report for your lot before any fill is ordered, because flood planning levels change as flood studies are updated. |
| Trees and clearing | On non-rural land, clearing declared vegetation needs Council approval, which is free to lodge. That includes native plants 4 m or taller or 10 cm or more in diameter, any tree 40 cm or more in diameter, preferred koala food trees and threatened species. On rural RU1 and RU2 land, clearing native vegetation may need approval under the Local Land Services Act 2013. |
| Driveways and the road reserve | Any work in the road reserve, including a driveway across the verge or a kerb and gutter change, needs Council consent under section 138 of the Roads Act 1993 before it starts. |
| Near creeks and the estuary | To count as exempt development, earthworks must be at least 40 m from natural water and must not redirect water or carry sediment onto a neighbour's land. Work on waterfront land can also need a controlled activity approval from NSW Water. |
| Fire ants | Parts of the Tweed are in the NSW fire ant biosecurity zone. Earthmoving machinery must be cleaned free of soil before it leaves, and soil, fill and quarry products moved out of the area follow set rules. Zones change, so check the current NSW DPIRD maps. |

Questions about earthworks in Casuarina
Can I dig into the bund behind my back fence?
Not without checking. Council's Casuarina Beach code, still in force under DCP 2025, says the finished ground levels of the acoustic bund on the eastern side of the relocated Tweed Coast Road are not to be altered within 1 m of the boundary unless current noise standards are still met. Ask Council before planning a trench, garden bed or level change near it, and include its reply when you send Luke your photos.
Does Tweed Shire Council need to approve my earthworks?
It depends on the job. Small earthworks can be exempt development if they meet the NSW standards, such as staying at least 40 m from natural water and not sending water or sediment onto a neighbour. Fill, acid sulfate soils, flood-prone land, trees and work in the road reserve each have their own approvals. Check with Council on 02 6670 2400 before the machine is booked.
